1.1 These Terms & Conditions (“Terms”) govern your use of the Forpartum mobile application (“App”) and website (“Website”), owned and operated by Forpartum LLC.
1.2 By accessing or using Forpartum, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please discontinue use immediately.
1.3 Forpartum reserves the right to update or modify these Terms at any time.

1.3.1 The “Effective Date” at the top will be updated upon changes.
1.3.2 When legally required, notice will be provided within the App.
1.3.3 Continued use of Forpartum after changes constitutes acceptance.

2. Privacy Policy & Data Protection

2.1 By using Forpartum, you agree to the Privacy Policy.
2.2 Key privacy commitments include:

2.2.1 No personal identifiers (name and email are anonymized upon storage).
2.2.2 No advertisements or sale of user data.
2.2.3 No third-party behavioral tracking.
2.2.4 Role-Based Access Control: Only the Super Admin (Founder) has access to anonymized user logs.

4. User Accounts & Security

4.1 Account Registration

4.1.1 Requires name and email (anonymized).
4.2 User Responsibilities
4.2.1 Provide accurate information.
4.2.2 Keep login credentials secure.
4.2.3 Report unauthorized use to support@forpartum.com.
4.3 Age Restrictions
4.3.1 Must be 18+ to register.
4.3.2 Parents/guardians may use on behalf of minors and are fully responsible.
4.4 Account Deletion & Retention
4.4.1 Users may delete accounts anytime.
4.4.2 Forpartum may terminate accounts that violate Terms.
4.4.3 All personally identifiable data is deleted upon account removal.

5. Health Disclaimer

5.1 Forpartum provides general wellness support.
5.2 We do not:

5.2.1 Offer medical advice.
5.2.2 Diagnose or treat any condition.
5.2.3 Replace professional healthcare.
5.3 Always consult a healthcare provider before making health decisions based on app insights.

6. Acceptable Use & Prohibited Conduct

6.1 Users must NOT:

6.1.1 Upload or share infringing or illegal content.
6.1.2 Use the app for malicious or fraudulent purposes.
6.1.3 Attempt to reverse-engineer or access the app’s code.
6.1.4 Circumvent security protocols.
6.1.5 Break any applicable laws.
6.2 Violations may result in suspension or termination.

7. Intellectual Property Rights

7.1 All content, design, and technology are owned by Forpartum LLC.
7.2 Trademark

7.2.1 “Forpartum” is a registered trademark.
7.3 Patent
7.3.1 Forpartum includes patent-pending Evolving Nurturing Technology™.
7.4 Users may NOT:
7.4.1 Reuse, copy, or redistribute Forpartum content or technology.
7.4.2 Use Forpartum branding or materials without written consent.

8. Partum Music

8.1 Description

8.1.1 Partum Music provides original music and sound experiences for postpartum well-being.
8.2 Usage Rights
8.2.1 For personal, non-commercial streaming use only.
8.2.2 Users may not copy, download, record, or distribute music.
8.3 Intellectual Property
8.3.1 All compositions are the exclusive intellectual property of Forpartum.
8.3.2 Includes all sound design and curated musical arrangements.
8.3.3 Unauthorized use is strictly prohibited.
8.4 Wellness Disclaimer
8.4.1 Partum Music is not a substitute for medical advice or therapy.
8.5 Feature Availability
8.5.1 Forpartum may modify or remove music features at any time without notice.

9. Audio Content (Partum Sound)

9.1 Description

9.1.1 Partum Sound includes guided meditations, educational narrations, and spoken-word sessions.
9.2 Usage Rights
9.2.1 For personal, non-commercial use within the Forpartum App only.
9.2.2 Downloading or redistributing content is prohibited.
9.3 Intellectual Property
9.3.1 All audio content is the exclusive property of Forpartum.
9.3.2 These works reflect proprietary creative processes.
9.4 Disclaimer
9.4.1 Not a replacement for therapy or clinical support.
9.5 Availability
9.5.1 Forpartum reserves the right to update or remove audio content at any time.

10. Disclaimers & Limitation of Liability

10.1 Forpartum is provided “as is.”
10.2 No warranties for uninterrupted or error-free service.
10.3 Limited liability:

10.3.1 Not responsible for health outcomes or user decisions.
10.3.2 Not liable for data loss, technical disruptions, or third-party content.
10.4 Maximum liability is limited to the amount paid (if any).

11. Governing Law & Dispute Resolution

11.1 Jurisdiction: Arizona, USA.
11.2 Binding arbitration for disputes.
11.3 Class action waiver: Users agree not to file class-action lawsuits.

12. Subscriptions, Billing & Refunds

12.1 Pricing

12.1.2 Early adopters: $7.99/year limited-time
12.2 Payments
12.2.1 Handled via Apple App Store and Google Play Store.
12.2.2 Subject to store terms.
12.3 Auto-Renewal
12.3.1 Subscriptions renew automatically unless canceled.
12.4 Refunds
12.4.1 Refunds must be requested through the app stores.
12.4.2 Forpartum does not issue direct refunds.
12.5 Responsibility
12.5.1 Users are responsible for canceling before renewal.

13. Third-Party Services & Integrations

13.1 Forpartum does not integrate with tracking-based third parties.
13.2 If tools like Apple Health or Google Fit are added in the future, explicit opt-in will be required.
13.3 Data will never be sold or shared with outside platforms.

14. Limited Liability for Technical Issues

14.1 No guarantee of 100% uptime.
14.2 Not liable for bugs, errors, or compatibility issues.
14.3 Users must ensure their device meets system requirements.

15. User Content & Community Guidelines

15.1 Users may not:

15.1.1 Post harmful or misleading content.
15.1.2 Harass, impersonate, or threaten others.
15.1.3 Share unsafe health claims or medical misinformation.
15.2 Violations may result in suspension or termination.

16. Termination of Services

16.1 Forpartum LLC may:

16.1.1 Suspend or terminate user accounts.
16.1.2 Discontinue features or services at any time.
16.1.3 Modify pricing with notice.
16.2 If Forpartum shuts down, all user data will be deleted permanently.

17. Force Majeure

17.1 Forpartum is not responsible for service failures due to:

17.1.1 Natural disasters, pandemics, or government orders.
17.1.2 Cybersecurity attacks or external breaches.
17.1.3 Third-party platform outages.

18. Postpartum Specialist Directory

18.1 The Forpartum App may include a Postpartum Specialist Directory listing midwives, doulas, lactation consultants, therapists, or other postpartum professionals.

18.2 These specialists are independent providers and are not employees, contractors, or affiliates of Forpartum LLC.

18.3 Forpartum does not guarantee, endorse, or take responsibility for the services, advice, or communication provided by these specialists.

18.4 Users are solely responsible for conducting their own due diligence before contacting or engaging with any listed provider.

18.5 Forpartum is not liable for any medical, emotional, legal, or financial outcomes resulting from engagement with directory-listed professionals.
