These Terms of Use ("Terms") govern your access to and use of the Forpartum mobile application, forpartum.com, and any content, accounts, subscriptions, digital downloads, courses, professional-directory features, products, and services that link to these Terms (together, the "Services"). The Services are offered by Forpartum LLC ("Forpartum," "we," "us," or "our").
By downloading, accessing, purchasing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Additional terms shown at purchase or within a particular feature also apply; if they conflict with these Terms, the more specific terms control for that feature.
You must be at least 18 years old and legally able to enter into a contract to create an account, purchase a product, or subscribe. The Services are not intended for children.
Provide accurate account information, protect your login credentials, and notify us promptly if you suspect unauthorized access. You are responsible for activity through your account unless prohibited by law. You may not sell, transfer, or share an account or subscription. We may require verification before restoring access or making account changes.
Forpartum provides educational, creative, and general wellness support relating to matrescence, pregnancy, birth, postpartum life, relationships, identity, nervous-system awareness, and professional education. The Services are not medical care, psychotherapy, crisis care, diagnosis, treatment, or an individualized care plan. Forpartum is not acting as your physician, midwife, therapist, emergency responder, or other licensed healthcare provider through the Services.
Information in the Services may not apply to your health, history, medications, pregnancy, recovery, or circumstances. Always use your judgment and consult an appropriately qualified professional for individual medical or mental-health questions. Never disregard or delay professional care because of content in the Services.
The Services are not monitored emergency services. ENT or another feature may display crisis resources or suggest contacting a trusted person or qualified professional, but no response, recommendation, or screen means that a person has reviewed your situation or will contact you. Forpartum cannot guarantee that a resource is available, appropriate, or current in every location.
If you or another person may be in immediate danger, contact local emergency services. In the United States, call 911 for an emergency or call or text 988 for the Suicide & Crisis Lifeline. If you have an urgent pregnancy, postpartum, infant, or other medical concern, contact an appropriate healthcare professional or emergency service immediately.
ENT is an educational content-recommendation system. It may use choices you make during a session — such as your current state, energy, intensity, available time, bandwidth, support, sensory needs, or preference for advice — to offer relevant content. ENT does not diagnose a condition, determine risk, replace professional judgment, or guarantee an outcome. Recommendations may be incomplete, unavailable, or unsuitable for your individual situation.
Some content or production workflows may be assisted by artificial-intelligence tools and then selected, designed, edited, or produced by Forpartum. AI-assisted content may contain errors. Do not rely on it for medical, legal, safety-critical, or other professional decisions.
Subject to these Terms, Forpartum grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the app and access the Services for your own non-commercial purposes on devices you own or control, subject to applicable app-store rules. You receive a license to use the Services; ownership of the app and content does not transfer to you.

Some app features require a paid subscription. The price, billing period, included access, and any trial or introductory offer will be shown before purchase. Unless stated otherwise, subscriptions automatically renew for the same billing period until canceled. Your payment method will be charged through the platform where you subscribed.
Cancel through the same platform used to subscribe — such as your Apple App Store or Google Play subscription settings — before renewal. Deleting the app or your Forpartum account does not necessarily cancel a store subscription. Cancellation normally stops future renewal and access continues through the end of the paid billing period, unless the platform or applicable law provides otherwise.
App-store purchases, billing disputes, and refunds are administered under the store's rules. Website purchases are governed by the refund terms shown at checkout and any posted Refund Policy. We may change future prices or plans with notice required by the applicable platform or law; a change does not alter a period already paid for. Taxes may apply.
Purchased workbooks, courses, audio, and other digital materials are licensed for your personal, non-commercial use. Access lasts for the period stated at purchase. If an offer uses "lifetime access," it means access for the commercial life of that product on the platform, not your lifetime or a promise that a platform will operate indefinitely. We may replace, update, move, or discontinue content, while honoring non-waivable consumer rights.
Product descriptions, availability, delivery estimates, and images are provided in good faith but may contain minor errors or variations. Title and risk of loss transfer as provided by applicable law and the carrier terms. Return eligibility and shipping responsibilities are stated in the Refund and Returns Policy presented at purchase.
A directory listing is informational and is not an endorsement, employment relationship, referral, credential verification guarantee, or promise of availability, quality, safety, licensure, insurance, or results. Professionals are independent third parties and are solely responsible for their services, representations, credentials, legal compliance, records, communications, and client relationships. Verify a professional's qualifications and suitability before engaging them. Forpartum is not a party to an agreement between you and a listed professional unless expressly stated.
Professional education is for training and informational purposes. Completing a program does not grant licensure, legal scope of practice, clinical competence, continuing-education credit, or permission to practice a regulated profession unless an offer expressly states otherwise. Each participant remains responsible for applicable laws, credentials, supervision, documentation, and professional judgment.
The Services and their text, frameworks, audio, music, courses, workbooks, stories, artwork, software, interfaces, designs, names, logos, and other materials are owned by Forpartum or its licensors and protected by intellectual-property laws. This includes, as applicable, FORPARTUM™, THE MATRESCENT PATH™, PROPARTUM INSTITUTE™, PARTUM MUSIC™, PARTUM SOUND™, PARTUM STORIES™, PARTUMPEDIA™, HOT MESS MATRESCENCE™, and related marks and frameworks. No rights are granted except the limited licenses expressly stated in these Terms.
You keep ownership of content you submit. By sending feedback, a review, story, testimonial, image, or other material for possible publication or promotion, you give Forpartum a non-exclusive, worldwide, royalty-free license to reproduce, edit for length or clarity without changing its meaning, display, and distribute that submission for the purpose you reasonably understood when submitting it. We will request additional permission before using a private support message as a public testimonial.
You represent that you have the rights and permissions needed for anything you submit and that it does not violate another person's privacy, publicity, copyright, or other rights. Do not submit identifiable information about a child or another person without lawful authority and appropriate consent. We may decline or remove a submission. Merely tagging or mentioning Forpartum on social media does not, by itself, grant us permission to use your content in marketing.
Forpartum wants its digital services and content to be usable by people with disabilities. Our Accessibility Statement describes our current efforts, known limitations, and how to request assistance or an alternative format. Accessibility is an ongoing process, and third-party platforms may have limitations outside our control. Contact contact@forpartum.com if you encounter a barrier. Nothing in this section limits rights available under applicable law.
Our Privacy Policy explains how we handle personal information. By using the Services, you acknowledge that you have reviewed it. Privacy choices and rights are governed by the Privacy Policy and applicable law.
The Services may depend on or link to app stores, payment providers, websites, devices, social platforms, directory professionals, and other third parties. Their services and content are governed by their own terms and privacy practices. Forpartum does not control and is not responsible for third-party services, except as required by law.
If you downloaded the app from Apple, these Terms are between you and Forpartum — not Apple. Apple has no obligation to provide maintenance or support and is not responsible for the app or related claims, except as required by Apple's applicable terms. Apple and its subsidiaries are intended third-party beneficiaries of this paragraph and may enforce it. Your use must comply with applicable App Store terms. Equivalent platform terms apply when you obtain the app through Google Play or another authorized store.
We may update, test, add, remove, suspend, or discontinue features or content and may require app updates for security or operation. We do not guarantee that every feature or item will always be available, compatible with every device, or accessible in every location.
You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or harm, failed to pay, misused content, or if required for security or legal reasons. Where appropriate, we will provide notice and an opportunity to address the issue. Terms that by their nature should survive termination — including ownership, disclaimers, liability limits, and dispute provisions — will survive.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, ACCESSIBLE ON EVERY DEVICE, OR THAT CONTENT OR RECOMMENDATIONS WILL BE ACCURATE, COMPLETE, CURRENT, OR PRODUCE A PARTICULAR RESULT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORPARTUM AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING FROM OR RELATING TO THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT OR (B) US\$100.
These limitations do not apply where prohibited by law and do not exclude liability that cannot legally be excluded, including any applicable liability for fraud, willful misconduct, or personal injury caused by negligence.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Forpartum and its owners, employees, and contractors from third-party claims, liabilities, damages, and reasonable expenses arising from your unlawful misuse of the Services, infringement of another person's rights, or material breach of these Terms. This obligation does not apply to the extent a claim results from Forpartum's own conduct.
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules, except that mandatory consumer protections in your place of residence continue to apply. Before filing a claim, you and Forpartum agree to try in good faith for 30 days to resolve the dispute informally by writing to contact@forpartum.com. Unless applicable law permits or requires another forum, claims will be brought in the state or federal courts located in Pima County, Arizona, and each party consents to their jurisdiction. Nothing in this section prevents either party from seeking urgent injunctive relief or using an eligible small-claims process.
If a court finds part of these Terms unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, financing, reorganization, sale, or operation of the Services. These Terms, the Privacy Policy, and any feature- or purchase-specific terms form the entire agreement about the Services and replace prior discussions about the same subject.
We may update these Terms as the Services or law changes. We will post the revised version with a new "Last updated" date and provide additional notice where required. Changes apply prospectively. If you do not agree to a material change, stop using the affected Service and cancel any renewal before the next billing date.
